Waiver of Liability

I know and understand that participating in farm activities, including but not limited to walking the property; picking produce, herbs and flowers; feeding, milking animals; mucking stalls; etc. (“Farm Activities”) may have certain risks, and I choose to do this out of my own free will and choice.

In choosing to participate in farm activities, I fully accept and assume all risks, whether before, during or after the Farm Activities. In the event of injury, illness, or other incapacity, I shall assume and pay my medical and emergency expenses, regardless of whether I authorized such expenses, and/or in the event these expenses are not covered by any insurance programs of the Farm.

As I am not an employee, I understand that Willapa Bay Heritage Farm (“WBHF”) nor the Willapa Bay Heritage Farm Foundation (“WBHF Foundation”) do not carry or maintain Worker’s Compensation or Employer’s Liability Insurance for me or any other guests during Farm Activities.

Knowing these facts, I for myself and anyone acting on my behalf, release, covenant not to sue and agree to hold WBHF, LLC and the WBHF Foundation, its subsidiaries, joint ventures, officers, directors, employees, representatives, agents, insurers, and successors of WBHF LLC and/or the WBHF Foundation, harmless from any and all claims, demands and actions of every kind I have or may have relating in any way to my participating in the farm activities.

I further agree to hold the parties released above harmless from all losses, damages, claims and expenses, including attorney’s fees, relating in any way to my participation in the Farm Activities.

I agree to support the farm’s non-discriminatory practices on the basis of protected characteristics, including but not limited to race, color, religion, gender, gender identity, national origin or ancestry, age, medical condition/disability, veteran status, marital status, pregnancy, or sexual orientation/expression.

I have read, understood, and agreed to this Waiver of Liability Form.
